Avast is a digital subscription service that provides multiple layers of security and online protection for the User's devices. The Service is accessible through a mobile subscription and requires an internet connection.
Avast Premium Security provides protection for up to 10 Android, iOS, Windows and macOS devices against viruses, malware, phishing, ransomware and other online threats.
The Service is available to users of Orange users in Romania.
The User must be at least 18 years old and must be the account holder of the mobile phone number used to activate the subscription.
Access to the Service may vary depending on technical availability, the User's device, internet connection and mobile operator network coverage.
The subscription is activated after confirmation by the User through direct billing with Orange.
To activate the subscription, the User must enter a valid Romanian mobile phone number, receive an SMS containing a PIN code, and enter the PIN code to confirm the registration, payment and activation of the subscription.
By confirming the subscription, the User confirms that they have read and understood these Terms and Conditions, accepts the subscription and authorises the recurring monthly charge.
Avast Premium Security for up to 10 devices costs 11.99 EUR per month, VAT included.
Charges are billed monthly through Orange.
The subscription automatically renews every month until it is cancelled.
The Service is provided on a recurring monthly subscription basis. Payment is charged at the beginning of each monthly billing cycle.
At the end of each billing cycle, the subscription will automatically renew under the same conditions unless the User cancels the subscription or it is terminated by the Service Provider.
Any promotional offer or trial period, where applicable, will be clearly communicated to the User before the subscription is activated.
The User may cancel the subscription at any time by sending:

To prevent the next monthly renewal charge, the cancellation request should be submitted before the next billing date.
After cancellation, access to the Service will remain available until the end of the already-paid subscription period. The subscription will not renew, and no additional subscription charges will be applied.
The User may subscribe to the Service again at a later date.
The User is not subject to any long-term commitment and may cancel the subscription at any time.
By requesting immediate access to the digital Service, the User acknowledges and expressly agrees that the provision of the Service may begin before the end of any applicable statutory withdrawal period.
Where applicable under applicable Romania consumer protection law, the User's right of withdrawal may be affected once the provision of digital content or the Service has begun, subject to the requirements and conditions established by applicable law.
Mandatory consumer rights provided under applicable law remain unaffected.
Fees already charged are generally non-refundable, except where required by applicable law or in the event of a confirmed technical or billing error.
Any complaint concerning an incorrect charge should be reported to customer support or to the User's mobile operator.
The User may not resell, distribute, transfer or provide third parties with access to the Service.
The User must use the Service only for personal and lawful purposes.
The User may not use the Service for fraud, abuse, unauthorised commercial activity or any activity that may interfere with the operation, security or availability of the Service.
GigaPlay OÜ does not guarantee that the Service will always be uninterrupted, secure or error-free.
GigaPlay OÜ is not responsible for interruptions or failures caused by the mobile operator, internet connectivity, the User's device, third-party services, technical issues, force majeure events or circumstances beyond its reasonable control.
Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited under applicable consumer protection law.
To the extent permitted by applicable law, the maximum liability to the User will not exceed the total amount paid by the User for the Service during the three months preceding the event giving rise to the claim.
All content, software, trademarks, logos and materials available through the Service website are owned by, licensed to or lawfully distributed or promoted by GigaPlay OÜ and its partners.
Avast and the related Avast trademarks are owned by Gen Digital Inc. or its affiliated companies.
The User receives a personal, limited, non-exclusive, revocable and non-transferable right to access and use the Service during the active subscription period.
No ownership rights are transferred to the User.
GigaPlay OÜ reserves the right to modify the content, functionality, features, prices or conditions of the Service where reasonably necessary.
Any material changes will be communicated to the User through the Service website, by SMS, through the Service or through the relevant mobile operator, where required by applicable law.
Changes will not affect any mandatory consumer rights available to the User.
GigaPlay OÜ processes the personal data necessary to provide, activate, bill, administer and support the Service.
The personal data processed may include the User's mobile phone number, IP address, device and browser information, mobile operator information, subscription and billing status, Service usage and technical information, and customer support communications.
Personal data is processed in accordance with applicable Romanian and EU data protection legislation, including the General Data Protection Regulation (GDPR), and the Service Privacy Policy.

GigaPlay OÜ may suspend or terminate access to the Service in cases of suspected fraud, abuse, unlawful use, non-payment, technical or security risks, or violation of these Terms and Conditions.
Where reasonably possible and legally required, the User will be informed of the suspension or termination.

These Terms and Conditions are governed by the applicable laws of Romania, without affecting any mandatory consumer protection rights available to the User.
Any dispute will be subject to the competent courts or dispute resolution bodies in accordance with applicable Romania law, without affecting any mandatory jurisdiction, consumer protection or alternative dispute resolution rights available to the User.
